Refunds & cancellation

Proposed terms for review · September 8, 2026

This proposed policy covers services offered by Francisco Gutierrez, North Dakota, USA, under the Precedent Systems brand. It must be incorporated into a written project agreement before it applies. It does not change existing contracts or remove mandatory legal rights.

Before work begins

If you cancel before work begins, payments are returned minus only nonrecoverable third-party costs you specifically approved in writing before they were incurred. Any deduction must be itemized and supported. Ordinary overhead, sales discussions, and undisclosed cancellation fees are not deductions under this policy.

After work begins

You pay for authorized work completed up to cancellation and approved, nonrecoverable third-party costs. The remaining unearned prepaid balance is returned. Work is valued using milestone prices or hourly rates and limits agreed before work began; rates are not invented after cancellation. Partial milestones require an itemized account and reasonable allocation of the agreed milestone price. Deductions cannot exceed authorized charges.

The parties should stop avoidable additional work and costs after cancellation. Paid-for deliverables are handed over according to the ownership and delivery terms in the project agreement.

Monthly services

Under the proposed default, you may cancel before the next billing date without an early-termination fee. Cancellation stops the next renewal. Service remains available through the paid billing period unless you request an earlier shutdown. Voluntarily ending an otherwise available service early does not normally result in a partial refund for that current period, unless your agreement or applicable law requires one.

Prepaid amounts for later, unstarted billing periods are returned. Charges after a timely cancellation are corrected and refunded. Cancellation takes effect when the request is received through the designated channel; a delayed acknowledgment does not extend billing. Any minimum term or different arrangement must be clearly agreed before purchase and cannot remove mandatory rights.

If Precedent cannot deliver

If agreed work cannot be delivered, the parties may agree in writing on a revised scope or timetable. If no resolution is agreed, prepaid amounts allocated to undelivered work are returned. If Precedent ends an ongoing service before the paid period finishes, unused prepaid service fees are refunded proportionately. This does not limit other remedies for defective work, breach of contract, or rights required by law.

Third-party subscriptions

Subscriptions purchased directly from other providers have their own billing and cancellation arrangements. Canceling Precedent does not necessarily cancel those subscriptions. Handover should identify which accounts the client needs to retain or cancel.

If Precedent collected a third-party cost, only an approved and genuinely nonrecoverable amount may be retained under this policy. Any recovered amount attributable to canceled work is returned to the client. No undisclosed administration, restocking, or processing fee is proposed.

Requesting cancellation or a refund

Use the monitored contact listed in your written agreement or invoice. Include your name, business name, relevant project or invoice, and whether you want cancellation, a refund, or both. A brief explanation can help resolve a problem but is not required to cancel. Do not send full card numbers, passwords, or private customer records.

Proposed handling times: acknowledge within three business days; provide an itemized decision within ten business days of receiving enough information to identify the transaction; and initiate any refund due within ten business days of that decision. Shorter legal deadlines take priority. Bank or processor posting time may be additional. Undisputed amounts should not be withheld solely because another part of the request is disputed.

Refunds normally use the original payment method. If unavailable, an alternative must be agreed securely. You are not required to accept credit instead of a refund owed to you.

Existing guarantees and your rights

This draft does not cancel an earlier promise or change an existing client agreement. Existing guarantees must be handled under the terms actually offered and applicable law. For new work, any guarantee must state its eligibility, duration, exclusions, claim process, and remedy. This policy creates no general 60-day guarantee.

Nothing prevents a lawful payment dispute, regulator complaint, court claim, or exercise of mandatory cancellation or refund rights. The policy needs review for the locations and customers served.
